Terms of Use
Please note: this document applies to the Aybuke app from its release on the App Store and may be updated before then.
Last updated: 14 October 2026
The short version. This summary helps you find your way around. It doesn't replace the full Terms below.
- These Terms are a contract between you and Okan Berk Manavoğlu (individual developer), the developer of Aybuke. They are not a contract with Apple.
- You must be at least 13. If you're under 18 (or under the age of majority where you live), you need permission from a parent or legal guardian. Section 4 is written for you.
- We design Aybuke with teens in mind: no tracking, no public feeds, no personalised ads, and cloud AI only after you opt in.
- On-device tools are always free. Free users get free credits every day, can watch an optional ad for 1 more credit a few times a day, and see an occasional ad after saving; the app shows the current numbers. Pro has no ads. Pro subscriptions renew automatically until you cancel them in your Apple Account settings. Purchased credits never expire, but if Apple refunds a purchase, we take back what's left of it (section 9).
- You keep the rights in your photos and, as far as the law allows, you own your results. Only upload photos you're allowed to use, and only edit people who agree to it.
- No sexual content, nothing sexual involving anyone under 18, no bullying or body-shaming edits, and no deep fakes meant to deceive. Our Acceptable Use & AI Content Policy has the details.
- AI can get things wrong. Your mandatory rights as a consumer are never affected.
1. About these Terms
These Terms of Use ("Terms") govern your use of the Aybuke iOS app and the related online services (together, the "Service"). The Service is provided by Okan Berk Manavoğlu (individual developer), Istanbul, Türkiye, Türkiye ("we", "us" or "our"). Our full contact details are in section 26.
By downloading, installing or using Aybuke, you agree to these Terms. If you don't agree, please don't use the Service.
These Terms are also the end-user licence agreement (EULA) for the Aybuke app. Section 24 contains additional terms that apply because you got the app from Apple's App Store.
The following documents form part of these Terms:
- our Acceptable Use & AI Content Policy (the "AUP"); and
- any additional conditions shown to you in the app for a specific feature or offer.
Our Privacy Policy and, for users in Türkiye, our KVKK Information Notice explain how we handle personal data. They are information notices, not contract terms.
Your purchases are also subject to Apple's terms, such as the Apple Media Services Terms and Conditions, which apply between you and Apple.
2. Key definitions
- Cloud AI features: features that send content from your device to our servers and AI providers for processing. These are Magic Edit, Styles, AI Enhance, Erase and Create from text.
- On-device features: features that run entirely on your iPhone and never send your photos to us. These are Remove background, Adjust and Effects (including the Digicam '04 look offered during onboarding).
- Inputs: the photos, masks (the areas you brush over) and text prompts you submit to cloud AI features.
- Outputs or results: the images the Service generates or edits for you.
- Credits: units you use to pay for cloud AI outputs (section 8).
- Pro: a paid Aybuke Pro subscription (section 9).
- Consumer: an individual acting for purposes outside their trade, business, craft or profession.
3. Who can use Aybuke
- You must be at least 13 years old to use cloud AI features, create an account or make purchases. Children under 13 can use only the free tools that run on their device, which send nothing to us.
- If you're under 18, or under the age of majority where you live, you may use Aybuke only with the permission of a parent or legal guardian. Your parent or guardian must agree to these Terms on your behalf and is responsible for your use of the Service, including any purchases. Section 4 explains what this means in practice.
- You may not use the Service if the law where you live prohibits it, or if we have previously banned you for breaking these Terms.
- If you use Aybuke on behalf of a business, you confirm that you're authorised to accept these Terms for that business.
We design Aybuke with teen users in mind, and we apply high-privacy defaults to everyone, whatever their age: no tracking, no profiling, no personalised ads, no public profiles or feeds, no sharing of data for marketing, a creations library that stays on your device, and cloud processing only after you opt in. Free members aged 13 and over see a few ads (section 8); there are none under 13 or with Pro. Our Privacy Policy explains how.
4. If you're under 18
This section is a plain-language summary for younger users. The rest of these Terms still applies to you.
- Talk to a parent or guardian first. You need their permission to use Aybuke. Talk to them before you buy anything or switch on cloud AI processing.
- Cloud AI may need their consent too. In the EU and EEA, if you're under the age of digital consent in your country (between 13 and 16, depending on the country), a parent or guardian must give or approve consent for cloud AI processing. In Türkiye, if you're under 18, your parent or guardian should give or approve this consent. Read the consent screen together.
- Purchases go through Apple. Purchases are charged to the Apple Account on your device. If you have a child account in Family Sharing, your parent or guardian may need to approve each purchase with "Ask to Buy". Never buy anything without permission.
- Ads are optional and never personalised. Without Pro, you may see a few ads suitable for everyone: one you can choose to watch for 1 credit when you've run out (a few a day, as the app shows), and sometimes one after you save. You never have to watch one, and they're never based on what you do in other apps.
- Only edit people who say yes. Don't upload or edit photos of other people, especially other young people, without their permission. Never create anything sexual, humiliating or mean about anyone.
- Think before you share. Your creations stay on your phone unless you share them. Once something is online, it can be hard to take back.
- Help is here. If something goes wrong, or someone uses Aybuke to hurt you, tell a trusted adult and report it to us (see the AUP). Parents and guardians can contact us at hello@buaze.com, including to delete their child's data.
5. Your account
No sign-up
Aybuke doesn't ask you to sign up or give us your name, email address or a password. When you first use a cloud AI feature or your credit balance on our servers, the app automatically creates an anonymous account, identified by a random user ID, with our backend provider. The app stores the session tokens for this account in the iOS Keychain on your device.
Optional Sign in with Apple
Where the app offers it, you can choose to sign in with Apple, for example to keep your credits when you switch or add a device; an active subscription stays with the Apple Account that bought it. Not every version of the app offers signing in, and it is never required to use Aybuke. When you sign in, the anonymous account on that iPhone is merged into your account, including its purchased credits. Signing out returns that iPhone to a new anonymous account; your credits stay with your account, and an active subscription stays with the Apple Account that bought it. Your photos and library are not synced between devices.
Keep your device secure
Anyone who can use your unlocked iPhone can use your account, your credits and your Pro benefits. Please protect your device with a passcode.
If you lose access
If you haven't signed in with Apple, access to your account depends on your device. If you lose access, for example after erasing your iPhone without restoring a backup, we may not be able to recover the account or its credit balance. You can restore an active Pro subscription with "Restore purchases" in the app. If you signed in with Apple, sign in again on your new iPhone to get your credits back. If you need help, contact us with the Order ID from your Apple purchase receipt and we'll do what we reasonably can.
Deleting your account
You can delete your account at any time in Settings → Delete my data & account. This permanently deletes your server account and all server-side records linked to it (credit wallet, credit ledger, job records, entitlement records, ad reward records and reports), as well as the creations library on your device. A one-way hash of your App Store download, with that day's free credits and any safety pause (section 8), isn't linked to your account after deletion and is kept for a limited time only to prevent abuse, as our Privacy Policy explains; so deleting your account doesn't reset free credits or a pause. If you signed in with Apple, we also revoke Aybuke's access to your Apple ID.
Any remaining credits, including purchased credits, are lost when you delete your account and cannot be restored or refunded. If you use a cloud AI feature again later, a new anonymous account is created.
Deleting your account does not cancel an Apple subscription. To stop future charges, cancel the subscription in your Apple Account settings (section 9).
6. What Aybuke does
Cloud AI features
- Magic Edit: edit a photo by typing an instruction.
- Styles: one-tap templates, such as 3D figurine, pro headshot, anime film still or restore old photo. Templates are designed to preserve the identity of the people in your photo.
- AI Enhance: sharpen, upscale and restore a photo.
- Erase: brush over an object to remove it.
- Create from text: generate images from a text description, with a choice of styles and aspect ratios. With Pro, you can create up to 4 images at once.
Some templates and styles are available only with Pro. We don't offer templates based on celebrities or other real people, and we don't offer body-reshaping or skin-lightening features.
On-device features
Remove background (using Apple's Vision framework), Adjust (brightness, contrast, saturation, warmth, sharpness and vignette) and Effects (retro looks such as Digicam '04, which is also offered during onboarding) run entirely on your iPhone. They are free, don't use credits and work without consent to cloud processing.
Likeness Lock
If you edit a photo of a person and the result doesn't look like you (or the person in the photo), you can re-run that edit once for free within 15 minutes, up to the number of free retries a day that the app shows.
Your library ("My Works")
Results you keep are stored only on your device, in the app's private storage. We don't keep a copy. If you delete the app, delete your creations or lose your device, your library may be lost. Save the results you want to keep to your Photos library.
No public profiles or feeds
Aybuke has no public profiles or feeds and doesn't publish your creations. They are shared only if you choose to share them (section 13).
AI providers
Cloud AI features are powered by third-party AI models that we access through AI inference providers. The providers we currently use are listed in our Privacy Policy. We may change providers or models to keep the Service working well, so results may differ over time.
Changes and availability
We keep improving Aybuke and may add, change or remove features, templates and styles. Where the law requires it, we'll keep the Service in conformity with these Terms and tell you about changes that negatively affect you.
Cloud AI features need an internet connection. They may sometimes be unavailable, for example during maintenance or an outage at one of our providers.
7. Cloud AI processing and your consent
Before any photo or prompt leaves your device for a cloud AI feature, the app asks for your explicit permission and names the companies that process it. Nothing is sent until you agree. If you're under 18, please read section 4 first.
You can withdraw your permission at any time in Settings → Cloud AI processing. If you do, cloud AI features stop working, but on-device features keep working.
We process your inputs only to provide the feature you request and to keep the Service safe. They are never used to train AI models. Our Privacy Policy explains the details.
8. Credits
How credits work
- One credit pays for one cloud AI output. For example, creating 4 images at once uses 4 credits.
- On-device features never use credits.
- Credits are spent in this order: daily credits first, then subscription credits, then purchased credits.
- If a job fails, is cancelled, is blocked by our safety filters or times out, its credits are returned to your balance automatically. You're never charged for a blocked or failed generation.
- A Likeness Lock retry (section 6) is free.
Free daily credits
Without an active Pro subscription, you get the number of free credits per day that the app shows. They refill every day at 00:00 UTC. Unused daily credits don't carry over to the next day.
Free daily credits belong to your download of Aybuke from the App Store, not to an account: every device and anonymous account used with the same Apple Account shares one daily allowance. They need the App Store to confirm your download (the app sends Apple's signed confirmation to our server). Without that confirmation, free credits can't be used, but purchased and subscription credits still can.
Pro credits
With an active Pro subscription, you get the monthly number of credits that the app shows, instead of daily credits. The yearly plan's free trial includes a smaller number of credits, shown before you start it; the full monthly number starts with your first paid period. Unused subscription credits roll over to the following month, up to two months' worth. Subscription credits belong to the subscription: if it moves to another account, they move with it, and they end when your subscription ends. If Apple refunds the subscription, or revokes it (for example when Family Sharing access to it ends), Pro and its subscription credits end at once, without waiting for the end of the period. If Apple reverses the refund, Pro comes back for the rest of that period (section 9).
Credit packs
You can buy credit packs as consumable in-app purchases. Purchased credits:
- never expire (but if Apple refunds a pack, its unused credits are taken back, as explained below);
- stay in your balance if your subscription ends;
- have no cash value and can't be exchanged for money;
- can't be transferred to another person or account; and
- are non-refundable, except through Apple's refund process or where mandatory law provides otherwise.
If Apple refunds a credit pack, we take back the credits from it that you haven't used yet: up to as many credits as the pack gave you come off your purchased credits. Credits you've already used stay used, and your balance never goes below zero. If Apple reverses the refund, we give those credits back.
Credits from ads
Without an active Pro subscription, when you're out of credits, you can choose to watch a short ad from Google AdMob for 1 credit, up to the number of times a day (UTC) that the app shows; the limit counts for your account and for your App Store download. Watching is always optional. The credit is added once Google confirms to our server that the ad played to the end; if it closes early, or Google doesn't confirm it, no credit is added. Credits from ads:
- are added to your free daily credits, are spent first and don't carry over to the next day;
- have no cash value and can't be exchanged for money;
- can't be transferred to another person or account; and
- may not be collected by automation, fake devices or anything else that isn't a real person watching the ad.
Free members may also see an occasional ad after saving or sharing a finished creation, never while they're editing and at most 3 a day. Pro members see no ads. We may change how ads appear, or stop offering credits for ads, for future periods; this never reduces credits already in your balance.
Fair use and limits
To protect the Service, we limit how many cloud AI jobs an account, an App Store download and a network address can start per minute, per hour and per day, and how many jobs all users together can start per day. When a limit is reached, the app tells you and cloud AI pauses for a while; nothing is charged.
If our safety filters block 3 of your requests or results within 24 hours, cloud AI pauses for 24 hours for your account and your App Store download (or, without a verified download, your network address). After 3 pauses within 30 days, we switch cloud AI off for that download until we've reviewed it. On-device features keep working, and you can ask for a human review (our AUP, section 9).
Credits are a licence to use cloud AI features in Aybuke. They are not money, property or a payment instrument, and they can only be used in the app.
Changes to credit allowances
We may change the free daily allowance or the monthly Pro allowance for future periods. We'll tell you in the app before such a change takes effect. A change never reduces credits already in your balance, and a change to the Pro allowance applies at the earliest from your next renewal, which you can cancel before it happens.
9. Aybuke Pro and other purchases
Apple handles payments
All purchases in Aybuke are made through Apple's in-app purchase system. Apple is the seller (merchant of record) and processes your payment. We never receive your card details, your name or your Apple Account email address.
Purchases are charged to the Apple Account used on your device. If you're under 18, you need the permission of a parent or guardian before buying anything, and the Apple Account holder or family organiser may need to approve the purchase (for example with Family Sharing's "Ask to Buy").
Plans and prices
- Aybuke Pro Yearly: USD 39.99 per year, with a 7-day free trial for eligible new subscribers.
- Aybuke Pro Monthly: USD 5.99 per month. Eligible new subscribers pay USD 1.99 for their first month, then USD 5.99 per month.
- Credit packs: 30 credits for USD 2.99, or 100 credits for USD 7.99.
These are reference prices in US dollars. The app shows the price in your local currency before you buy. Prices can differ between countries and may include taxes. The price shown when you confirm your purchase is the price you pay.
What Pro includes
- the monthly number of credits that the app shows, with rollover up to two months' worth (section 8);
- up to 4 images per generation;
- all templates and styles;
- exports without the Aybuke watermark;
- no ads; and
- higher-quality AI processing than the free plan.
Free trial
If you're eligible, the yearly plan starts with a 7-day free trial. Eligibility is decided under Apple's rules for introductory offers. The trial includes the number of credits shown on the paywall before you start it; the full monthly number of credits starts with your first paid period.
Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and you're charged the yearly price when the trial ends. If you allow notifications, the app reminds you before that cancel-by time: at least 26 hours before your trial ends, and earlier when that would fall at night or during school hours.
If you buy a subscription while you're in a free trial, any unused part of the trial is forfeited where applicable.
Automatic renewal
- Payment is charged to your Apple Account when you confirm your purchase or, if you started a free trial, when the trial ends.
- Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
- You can manage or cancel your subscription at any time in your iPhone's Settings → your name → Subscriptions, or in the App Store. Cancellation takes effect at the end of the current billing period, and you keep Pro until then.
- Deleting the app or your Aybuke account does not cancel your subscription.
Price changes
If we change the price of a subscription, Apple will notify you in advance and, where Apple's rules or the law require it, ask for your consent before your subscription renews at the new price.
Refunds
Apple handles refunds under its own policies. You can request a refund at reportaproblem.apple.com. We can't issue refunds for App Store purchases ourselves.
When Apple refunds or revokes a purchase, Apple tells our server, and we update your account to match:
- Pro: if Apple refunds your subscription, or revokes it (for example when Family Sharing access to it ends), Pro and its subscription credits end at once, without waiting for the end of the period. A refund for an earlier period doesn't end a newer period you've paid for.
- Credit packs: if Apple refunds a pack, we take back the credits from it that you haven't used yet, never taking your balance below zero (section 8).
- If Apple reverses a refund: Pro comes back for the rest of that period, and the credits we took back from a pack are returned to your balance.
Restoring purchases
You can restore an active subscription, for example on a new device, with "Restore purchases" in the app.
10. Right of withdrawal for consumers in the EU, UK and Türkiye
If you're a consumer in the European Union, the United Kingdom or Türkiye, you normally have a statutory right to withdraw from a contract concluded at a distance within 14 days.
Aybuke supplies digital content and digital services immediately at your request: credits are added and Pro features are unlocked as soon as your purchase is confirmed.
By making a purchase, you expressly request and consent to the immediate start of performance, and you acknowledge that you thereby lose your right of withdrawal, as permitted by:
- Article 16(m) of the EU Consumer Rights Directive (Directive 2011/83/EU) and the national laws implementing it;
- regulation 37 of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; and
- Article 15(1)(ğ) and (h) of the Turkish Regulation on Distance Contracts (Mesafeli Sözleşmeler Yönetmeliği).
This doesn't affect your other mandatory statutory rights, such as your rights if the Service is faulty or not as described. Apple's own refund and cancellation policies also apply to purchases made through the App Store.
11. Your content and AI results
Your inputs
You keep all the rights you have in your inputs.
You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, copy, transmit, modify and otherwise process your inputs, and to let our service providers do so on our behalf, solely to provide the feature you request and to keep the Service safe (for example, to run safety checks). This licence:
- does not allow us to use your inputs to train AI models;
- does not allow us to sell your inputs or use them for advertising; and
- ends when the processing of your request is complete, except for information you include in a report you send us, which we keep as described in our Privacy Policy.
Your results
As between you and us, you own the outputs created for you, to the extent permitted by law. To the extent we have any rights in your outputs, we assign them to you.
Please note:
- In some countries, images generated by AI are not protected by copyright, or are protected only in part.
- AI models can produce similar or even identical results for other users, especially from similar prompts or the same template. Your rights don't extend to other users' results.
- An output may contain elements protected by someone else's rights. Check this before you use a result, especially for commercial purposes.
You may use your outputs for any lawful purpose, including commercial purposes, subject to these Terms, the AUP and the rights of others.
Your responsibilities
You're responsible for your inputs and for how you use your outputs. You confirm that:
- you own your inputs or have all the rights and permissions needed to use them with Aybuke;
- every person shown in a photo you upload (or, for a child, their parent or guardian) has agreed to their image being uploaded and edited in the way you intend; and
- your inputs and your use of outputs comply with the law, these Terms and the AUP, and don't infringe anyone's rights, including copyright, trademark, privacy, publicity and personality rights.
12. AI labels, watermarks and disclosure
How we label AI content
Every image you export that was generated or edited with AI carries machine-readable provenance metadata (the IPTC "Digital Source Type" field in XMP), as required by Article 50(2) of the EU AI Act (Regulation (EU) 2024/1689). AI providers may also embed invisible watermarks, for example Google's SynthID. The label stays when you edit an AI result again in the app, and when you open a photo that already carries such a label, the app keeps it on export. Images you have only adjusted manually don't carry an AI label.
Watermark on free exports
On the free tier, exports of images made or edited with our cloud AI carry a small visible "Aybuke ✦" watermark in a corner. Pro exports don't, and neither do photos you have only changed with the free on-device tools.
Your obligations
- Don't remove, alter or forge AI labels or watermarks in order to deceive anyone about how an image was made.
- When you publish content that was generated or manipulated with AI, disclose this wherever the law or the rules of the platform you use require it.
- This applies in particular to deep fakes, meaning realistic images of real people, objects, places or events that could falsely appear authentic. For example, Article 50(4) of the EU AI Act requires anyone who uses AI in a professional capacity to disclose deep fakes, and platforms such as Instagram and TikTok have their own AI labelling rules.
13. Sharing your results
You can share results with the iOS share sheet (which also offers Instagram Stories), as a "Before / After" collage, or as a 9:16 story card or another card design. On the free tier, collages and cards of images made or edited with our cloud AI include a small "Made with Aybuke" mark; Pro removes it. The app can also suggest captions, with hashtags, for you to copy; captions are written on your device and nothing is sent anywhere to write them.
When you share, the receiving service's own terms and privacy policy apply, and you're responsible for what you publish. Make sure everyone shown in an image, including a before-and-after image, agrees to it being shared.
14. Acceptable use and safety
You must follow the AUP. In particular, you must not use Aybuke to create, upload or share:
- sexual content or nudity of any kind, including "nudify" or "undressing" edits and non-consensual intimate imagery;
- any sexualised or suggestive content involving anyone under 18 (we have zero tolerance and report child sexual abuse material to the competent authorities where the law requires it);
- photos of other people, especially minors, uploaded or edited without their consent (or, for a child, the consent of their parent or guardian);
- bullying or humiliating edits, or body-altering edits intended to shame or deceive;
- deep fakes intended to deceive, or content that impersonates real people or organisations;
- hate, harassment, threats, violent extremism, content promoting self-harm, or content that facilitates illegal activity; or
- content that infringes intellectual property, privacy or publicity rights.
You must not try to get around our safety filters, abuse free credits, or access the Service through automation, scraping, reverse engineering or resold access, except where the law expressly allows it.
Our safety systems may block a request or a result. Blocked requests are never charged. If you break the AUP, we may take the measures it describes, including suspending or deleting your account and reporting illegal content to the authorities.
15. Our intellectual property and your licence to use the app
The app, the Aybuke name and brand, the design, the template and style recipes and the software belong to Okan Berk Manavoğlu (individual developer) or its licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download, install and use the app on Apple-branded devices that you own or control, as permitted by Apple's Usage Rules (see section 24).
Except where the law expressly allows it, you must not:
- copy, modify, decompile, disassemble or reverse engineer the app or our server interfaces;
- access the Service by automated means (such as bots, scripts or scrapers) or through any interface other than the app;
- extract our templates, prompts or style recipes;
- rent, sell, sublicense or resell access to the Service or to credits; or
- remove our copyright or trademark notices.
The app includes third-party components, such as fonts, that are licensed under their own terms. You'll find these notices in Settings → Acknowledgements.
If you send us ideas or feedback, we may use them without any obligation to you.
16. Copyright and other rights complaints
If you believe that content generated or made available through Aybuke infringes your copyright or other rights, email us at hello@buaze.com and include:
- your name and contact details (postal address, telephone number and email address);
- a description of the copyrighted work or other right you believe has been infringed;
- a description of the material you believe is infringing, with enough information for us to find it (for example, the template name, a screenshot, or the date and time it was created);
- a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in your notice is accurate and, where applicable under penalty of perjury, that you are the rights holder or are authorised to act on its behalf; and
- your physical or electronic signature.
We review notices promptly and take appropriate action. This may include removing templates or other material we control and, in appropriate circumstances, closing the accounts of repeat infringers.
Because we don't store your inputs or keep outputs after delivery, we usually can't remove content that has been published elsewhere. Please also contact the platform where it appears. If you believe material was removed by mistake, you can use the appeals process in the AUP.
17. Third-party services
Aybuke works with services operated by others, such as Apple (App Store, payments and iOS features), Instagram and other apps you share to, the AI providers listed in our Privacy Policy, and Google AdMob, which provides the ads free members see. Their own terms apply to your use of their services. We don't control the content of ads, but we ask Google for non-personalised ads only, and for general-audience ads for anyone under 18 or whose age we don't know.
When using the app, you must comply with any third-party terms that apply to you, for example your mobile data plan. We're not responsible for third-party services that we don't control.
Some AI providers require us to pass on their usage restrictions to you. These restrictions are reflected in the AUP.
18. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available".
AI results are generated automatically and are often unpredictable. In particular:
- results can be inaccurate, unexpected or of low quality and, despite our safety measures, may occasionally be offensive;
- we don't guarantee that a result will look like you or anyone else; the Likeness Lock retry is a free second attempt, not a promise of likeness;
- restored or enhanced photos are AI reinterpretations and may contain details that were never in the original; and
- results are not suitable for purposes where accuracy matters, such as official identity photos, evidence, or medical or legal use.
We don't guarantee that the Service will be uninterrupted or error-free, or that any particular model, template or feature will remain available.
Nothing in these Terms excludes or limits any warranty or right you have under mandatory law, including your statutory rights as a consumer if the Service does not conform to the contract.
19. Limitation of liability
Nothing in these Terms limits or excludes our liability:
- for intent (wilful misconduct) or gross negligence;
- for death or personal injury caused by our negligence;
- for fraud or fraudulent misrepresentation; or
- that cannot be limited or excluded under applicable law, including mandatory consumer protection and product liability law.
Subject to the paragraph above and to the extent permitted by law:
- we're not liable for indirect or consequential loss, loss of profits, revenue, business or goodwill, or loss of data, including creations stored only on your device;
- we're not liable for how you or others use outputs, or for content you publish or share; and
- our total liability arising out of or in connection with the Service is limited to the total amount you paid for Aybuke purchases in the 12 months before the event giving rise to the liability.
If you're a consumer in the EU, the UK or Türkiye
We're responsible for foreseeable loss and damage caused by our breach of these Terms or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen, or if both of us knew it might happen when you accepted these Terms. We're not responsible for loss that wasn't foreseeable.
Where the law allows us to limit liability for slight negligence, we're liable for it only if we breach an essential contractual obligation (one that makes the proper performance of the contract possible and on which you can regularly rely), and only up to the typical, foreseeable damage.
The liability cap above doesn't apply to you where mandatory law prevents it.
20. Indemnity
To the extent permitted by applicable law, you agree to indemnify Okan Berk Manavoğlu (individual developer) against claims by third parties, and related reasonable costs (including reasonable legal fees), that arise from your inputs, your use of outputs or your breach of these Terms or of anyone's rights, to the extent the claim results from your fault.
This section doesn't apply if you're a consumer and the law where you live doesn't allow such an obligation.
21. Suspension and termination
By you
You can stop using Aybuke at any time and delete your account (section 5). Remember to cancel any subscription with Apple.
By us
We may restrict, suspend or terminate your access to all or part of the Service if:
- you seriously or repeatedly break these Terms or the AUP;
- the law or a competent authority requires us to do so; or
- it's necessary to protect other users, third parties, the Service or us from harm, fraud or abuse.
We act proportionately. Where appropriate, we'll first block a request or warn you. When we restrict your account, we'll tell you the reasons and how to appeal, unless the law prevents us or doing so would undermine safety or an investigation. For the most serious violations, such as anything involving the sexual exploitation of children, we may close accounts immediately.
If we close your account because of a serious breach, unused credits are forfeited to the extent permitted by law.
If we discontinue the Service
We may discontinue Aybuke or its cloud AI features. If we do, we'll give you reasonable advance notice in the app. You may be entitled to a refund from Apple for any prepaid period you can no longer use, under Apple's policies and applicable law.
What continues to apply
Sections 11, 15, 16, 18, 19, 20, 23 and 25 continue to apply after your use of the Service ends.
22. Changes to these Terms
We may update these Terms to reflect changes to the Service, the law or our business, or for security reasons.
If a change is material, we'll notify you in the app at least 30 days before it takes effect, unless a shorter period is required for legal or security reasons or the change only concerns new features. The "Last updated" date at the top shows when these Terms last changed.
If you don't agree with a change, you can stop using the Service and delete your account before the change takes effect. If you have a subscription, you can cancel it in your Apple Account settings. If you continue to use the Service after the change takes effect, the updated Terms apply.
23. Governing law and disputes
Governing law: the laws of the Republic of Türkiye, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
Place of jurisdiction: the courts and enforcement offices of Istanbul (Çağlayan), Türkiye.
If you're a consumer, this choice of law doesn't deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence, and the choice of courts doesn't apply where mandatory law allows you to go to your local courts. In particular:
- Consumers in Türkiye may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court (Tüketici Mahkemesi) at their place of residence or where the transaction took place, within the monetary limits set each year under Consumer Protection Law No. 6502. Where the law requires it, mediation must be tried before going to the Consumer Court.
- Consumers in the EU and EEA keep the protection of the mandatory consumer laws of their country of residence and may bring proceedings in the courts of the country where they live.
- Consumers in the UK may bring proceedings in the courts of England and Wales, Scotland or Northern Ireland, depending on where they live, and keep the protection of mandatory UK consumer law.
Before starting formal proceedings, please contact us at hello@buaze.com so that we can try to resolve the issue together.
24. Apple App Store additional terms
These terms apply because you got Aybuke from Apple's App Store. If they conflict with other provisions of these Terms, this section prevails with respect to your use of the app. These Terms don't set usage rules for the app that conflict with the Apple Media Services Terms and Conditions.
- Parties. These Terms are concluded between you and Okan Berk Manavoğlu (individual developer) only, and not with Apple Inc. ("Apple"). Okan Berk Manavoğlu (individual developer), not Apple, is solely responsible for the app and its content.
- Scope of licence. Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where available.
- Maintenance and support. Okan Berk Manavoğlu (individual developer) is solely responsible for providing any maintenance and support services for the app, as set out in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for the app.
- Warranty. Okan Berk Manavoğlu (individual developer) is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the sole responsibility of Okan Berk Manavoğlu (individual developer).
- Product claims. Okan Berk Manavoğlu (individual developer), not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. These Terms don't limit the liability of Okan Berk Manavoğlu (individual developer) to you beyond what is permitted by applicable law.
- Intellectual property. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, Okan Berk Manavoğlu (individual developer), not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Please direct any questions, complaints or claims about the app to Okan Berk Manavoğlu (individual developer), Istanbul, Türkiye, Türkiye, email hello@buaze.com.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the app, for example your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
25. General provisions
- Entire agreement. These Terms, including the AUP and any feature-specific conditions shown in the app, are the entire agreement between you and us about the Service and replace any earlier agreements on the same subject.
- Severability. If any provision of these Terms is found invalid or unenforceable, the rest remains in effect. To the extent permitted by law, the invalid provision is replaced by a valid one that comes closest to its purpose.
- No waiver. If we don't enforce a provision straight away, we can still enforce it later.
- Assignment. You may not transfer your rights or obligations under these Terms to anyone else. We may transfer ours to another company, for example as part of a merger, acquisition or sale of assets, provided this doesn't reduce your rights. We'll tell you if this happens.
- Force majeure. We're not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, war, epidemics, power or internet failures, or outages at third-party providers.
- Language. These Terms are available in English and Turkish. If you live in Türkiye, the Turkish version applies. Otherwise the English version applies, unless mandatory law requires that a version in your language prevails.
- Notices. We may give you notices in the app or by updating these Terms. You can send notices to us using the details in section 26. Formal notices to us in Türkiye can also be sent to our registered email (KEP) address.
